Residency Requirements
Before you initiate the divorce process in New York, you must meet certain residency requirements. To file for divorce in a New York court, at least one of the following conditions must be met:
- One spouse must have continuously lived in New York State for at least two years prior to filing for divorce.
- Alternatively, if one spouse has lived in New York State for at least one year before filing and either the marriage occurred in New York or the couple lived together in New York as a married couple, you can proceed with the divorce.
- Another option is if one spouse has resided in New York State for one year, and the reasons leading to the divorce occurred within New York.
- Lastly, if both spouses were residents of New York at the time of filing for divorce and the reasons for seeking the divorce happened within the state, you can file for divorce in New York.
In New York, couples seeking divorce can opt for either a no-fault divorce or a fault-based divorce.
A no-fault divorce occurs when the marriage has been irreparably broken for six months prior to filing for divorce, indicating that the couple believes their marriage cannot be salvaged or reconciled.
Alternatively, spouses have the option to seek a fault-based divorce by citing reasons such as:
- Inhuman treatment
- Abandonment
- Imprisonment
- Adultery
- Living apart based on a separation judgment or agreement.
