DIVORCE LAWYERS SERVING HAUPPAUGE, NY

Hauppauge Divorce Lawyer

“I attribute my overall success to the fact that I truly care.”

- Chris Palermo

Our Hauppauge office is at 1300 Veterans Memorial Highway, Suite 320A, just off Exit 57 of the Long Island Expressway. It’s the firm’s main office, and it sits about ten minutes up Carleton Avenue from the Suffolk County Supreme Court building in Central Islip, where every Hauppauge divorce is heard. Suffolk County Family Court is in the same Central Islip complex.

Hauppauge is split between the Town of Islip and the Town of Smithtown along Townline Road, so two neighbors on the same street can pay different town taxes and send their children to different school districts. That split shapes custody schedules, and we build parenting plans around it rather than around a generic calendar.

The hamlet is also home to the Long Island Innovation Park at Hauppauge, formerly the Hauppauge Industrial Park, and to most of Suffolk County’s government offices. Many of the spouses we represent here own or work for a company in the park, or hold a county or state job with a public pension. Dividing that kind of income and retirement takes records most couples have never pulled. For how New York handles property and support in general, see our Long Island divorce attorney page.

Divorce for Innovation Park Families

About 1,400 companies employ more than 55,000 people in the park along Motor Parkway, Marcus Boulevard, and Old Willets Path. If your marriage includes a business there, its value is marital property even when only one spouse’s name is on the lease. We work with neutral appraisers to value a park manufacturer, contractor, or professional practice from its tax returns, customer contracts, and what the owner actually takes out of it.

If you’re an employee rather than an owner, the harder questions are usually deferred compensation, stock awards that vest after the divorce is filed, and a 401(k) that mixes pre-marriage savings with marital contributions. We trace those accounts and draft the orders that divide them.

Spousal Support on Long Island

Public Pensions and Hauppauge Households

Suffolk County’s main government offices are in Hauppauge, and county, state, and school district workers make up a large share of Hauppauge households. A New York State and Local Retirement System pension is marital property for the years it was earned during the marriage, and dividing it requires a domestic relations order the retirement system will accept.

Health coverage, sick-leave payouts, and survivor benefits tied to that pension have to be addressed before the judgment is signed. They can’t be fixed afterward without going back to court.

THE CHRIS PALERMO LAW DIFFERENCE

Comprehensive Hauppauge Divorce Representation You Can Trust

Chris Palermo has practiced divorce and family law in Suffolk County for 20 years. His partner, Riley Perry, is a member of the Suffolk County Bar Association and its Matrimonial and Family Law Committee. Together they bring 30 years of combined experience to the matrimonial parts in Central Islip, a short drive from this office.

You meet your attorney at our main office, not at a satellite. Calls and emails are returned within 24 hours, and our office staff speaks Spanish.

Custody Across the Hauppauge and Smithtown District Lines

Hauppauge children attend either the Hauppauge Union Free School District or, in the northeastern part of the hamlet, the Smithtown Central School District. Parents who separate across Townline Road, or across the LIE into Commack, Central Islip, or Islandia, need a custody order that says which home is the child’s residence for enrollment, who covers the bus stop, and how midweek exchanges work around two different school calendars.

Many Hauppauge parents commute west on the LIE or work shifts in the park. A schedule that ignores a 6 a.m. start or a Sunrise-to-Northern-State commute fails in the first month. We write schedules around the hours you actually keep.

The House North or South of the Expressway

Hauppauge homes range from the older colonials and splits south of the LIE to larger properties along the Nissequogue River and near Blydenburgh County Park on the Smithtown side. Town of Islip and Town of Smithtown parcels carry different tax rates and different school taxes, which changes what the house costs to keep. A buyout has to reflect the real carrying cost, not just the appraisal.

If one spouse wants to stay in the Hauppauge district for the children, we structure the division so that’s possible, whether through a buyout funded by the other spouse’s share of retirement accounts or through a deferred sale with clear terms.

Talk to an Attorney

Litigation or Mediation, Minutes From the Courthouse

Most Hauppauge divorces settle. When both spouses want a lower-conflict path, Chris and Riley also handle mediation, and the agreement is reviewed line by line before you sign. If talks stall, the Central Islip courthouse is ten minutes away and your attorney already knows the file.

After the Judgment

Hauppauge families come back when a park employer closes, a bonus structure changes, or a former spouse stops paying. We handle child support modifications, custody changes, and enforcement petitions in Suffolk County Family Court, and we draft the deed transfers and retirement orders that finish dividing the property.

Frequently Asked Questions

Answers for Long Island families

In Suffolk County Supreme Court. Matrimonial cases are heard mostly at the Floyd Supreme Court Building, 400 Carleton Avenue in Central Islip, about ten minutes south of our office. Most papers are filed electronically through NYSCEF, and later custody or support changes usually go to Suffolk County Family Court in the same complex.

For the divorce filing, no. Both go to the same courthouse. For the settlement, yes. The two towns carry different tax rates and feed different school districts, which affects what the house costs to keep and where the children will be enrolled after the divorce.

Usually yes, for the portion built during the marriage, even if you never worked there and your name isn’t on it. The business is valued by an appraiser using tax returns, financial statements, and customer records, and your share is typically paid through a buyout or an offset against other assets rather than by splitting the company.

The share earned during the marriage is marital property. It’s divided with a domestic relations order that the retirement system approves, and the order has to address survivor benefits and the date of separation. Getting the language right the first time avoids a second round in court.

It depends on how many issues are contested and whether a business or pension needs an expert valuation. Uncontested divorces cost far less than cases that go through discovery and hearings. When one spouse earns substantially more, the court can order that spouse to contribute to the other’s legal fees. Your first consultation at our Hauppauge office is free.

Often, if the custody order names a Hauppauge address as the child’s residence for enrollment and the parenting schedule supports it. If neither parent can afford to stay in the district, the order can set a transition plan so the change happens at a natural break in the school year.
